Terms of service

1. What is being provided

Phobify installs a PhobGCC 2.0.5 board and a tactile Z switch into a GameCube controller that you supply, flashes firmware v0.31, reassembles the controller and function-tests it before return. That is the $99.99 install.

A newly installed board requires stick calibration before it performs correctly. The $19.99 Calibration & Tuning add-on covers that calibration along with trigger mode configuration, button remapping, snapback filtering and rumble strength. Without the add-on, calibration is left for you to perform using the project's published guide.

Parts sourcing is not included. Additional work such as paracord, buttons, springs or a replacement shell may be performed where you supply the parts, quoted in advance by email. Such work is not covered by these terms unless agreed in writing.

2. Orders and payment

Orders placed through Etsy are also governed by Etsy's policies, and Etsy handles payment, refunds and any buyer protection claim.

Direct orders are invoiced and paid in full before work begins. Prices are in US dollars and exclude shipping and any applicable sales tax, which is collected where required.

Phobify may decline or cancel an order for any lawful reason, including capacity. If an order is declined after payment, it is refunded in full.

3. Shipping and risk of loss

You are responsible for shipping your controller to Phobify and for the cost of doing so. Insuring that shipment is recommended. Phobify is not responsible for loss or damage occurring in transit before the controller is received.

Risk passes to Phobify when the controller is received, and passes back to you when it is handed to the return carrier. Return shipments are insured.

Service is offered to addresses within the United States. Local dropoff and collection is available around Cleveland / NE Ohio by arrangement.

4. Turnaround

Usually 3-5 business days is an estimate, not a guarantee. The clock starts when your controller lands, not when you order. Current capacity is posted on every page before you order. Delays caused by carriers, compatibility problems, or a controller arriving in unexpected condition are outside our control and are not grounds for a refund of work already performed.

5. Condition on arrival

Controllers arriving with damage, heavy wear or unexpected modification will be reported to you by email, with options, before any further work is carried out. Nothing is done to a controller without the owner's agreement.

Pre-existing wear is not caused by the install. Worn triggers, tired stickboxes, cracked posts and failing rumble motors are common in controllers of this age.

The board is a drop-in replacement for the OEM motherboard. Third-party controllers not using OEM internals cannot accept it. Where a controller is found to be incompatible, no service fee is charged and the controller is returned to you, with return shipping at your cost.

6. Cancellation and refunds

You may cancel for a full refund at any time before work begins.

If you cancel after your controller has arrived but before work begins, the service fee is refunded in full and the controller is returned to you. Return shipping in that situation is your responsibility, and will be quoted to you for approval before the controller is sent.

Once a board has been installed, the work cannot be undone at no cost. Cancellation after that point is handled case by case, and any refund is reduced by the cost of parts already fitted and work already performed.

Refunds on Etsy orders are processed through Etsy. Refunds on direct orders are returned by the original payment method.

7. Liability

Reasonable care is taken with every controller in our possession. If a controller is lost or damaged through our error while it is with us, we will repair it or compensate you for the fair market value of the controller, whichever is lower.

That is the full extent of our liability. We are not liable for indirect or consequential losses, including missed tournaments, events or travel costs. Total liability for any order will not exceed the amount paid for that order plus the fair market value of the controller. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this may not apply to you.

Nothing in these terms limits liability that cannot lawfully be limited.

8. Warranty

Completed work carries a 90-day limited warranty. What is covered, what is excluded and how to make a claim are set out in the Limited Warranty.

9. Unclaimed controllers

Occasionally a controller is finished and the owner cannot be reached, or does not arrange return shipping. This section sets out what happens, because indefinite storage is not something a small operation can offer.

When work is complete, or when a controller is found to be incompatible, you will be notified by email at the address on your order. If 60 days pass from that notice without a response and without return shipping being arranged, the controller is treated as abandoned.

Before that point:

• At least two further attempts to contact you will be made and logged
• A final written notice will be sent to the most recent postal or email address on file, stating the deadline and what follows it
• You may reclaim the controller at any time before the deadline by paying any outstanding balance and return shipping

After the deadline, Phobify may dispose of the controller and recover unpaid charges from its value. Any surplus remains available to you on request for twelve months. Keeping a current email address on your order is your responsibility.

10. Your responsibilities

• Include your name and order number in the package. Unlabeled controllers cannot be matched to an order and will be delayed.
• Send the controller only, unless asked for something else.
• Tell us before shipping if the controller is aftermarket, previously modified, or already damaged.
• Confirm that you own the controller, or are authorised to have it serviced.

11. Open source and trademarks

PhobGCC is an open-source project maintained by the PhobGCC team. Its hardware is released under CERN-OHL-S and its firmware under GPLv3, both of which permit commercial use. Phobify is an independent installer and is not affiliated with, sponsored by or endorsed by the PhobGCC project or Nintendo. GameCube and Nintendo are trademarks of Nintendo.

12. Governing law

These terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Lorain County, Ohio, and you consent to that venue.

13. Changes and severability

These terms may be updated. The version in effect when you place an order is the version that applies to it, and the date at the top of this page records the most recent change.

If any part of these terms is found unenforceable, the rest continues to apply.
